Terms of Service

1. General Terms & Legal Capacity
By contracting the services of WavingCode, the client declares to be 18 years of age or older, possessing the legal capacity to enter into a contract, and certifies that the funds used for payment originate from lawful sources. The use of our services for any illicit purpose will result in the immediate termination of the account without notice.
2. Service Nature & Technical Limitations
2.1 Intermediation: The client acknowledges that WavingCode may act as a direct provider, administrator, or reseller. Therefore, services are subject to the limitations and scope of the original infrastructure providers.
2.2 Third-Party Software: WavingCode is not responsible for changes, updates, bugs, or modifications to hardware or software associated with the service (e.g., DirectAdmin, cPanel, PHP versions, Softaculous scripts). Any interface change or functional defect in these tools is not considered a breach of contract.
2.3 Uptime: We aim for a 99% uptime, excluding scheduled maintenance. Third-party monitoring reports are not accepted as the sole evidence of service downtime.
3. Domain Management
3.1 Registration: Domains are registered through reseller accounts. Clients may request the transfer of a domain to their own name provided there are no outstanding balances and the client assumes the transfer costs.
3.2 Renewals: It is the sole responsibility of the client to renew domains on time. Once the expiration date has passed, WavingCode does not guarantee recovery, and additional reactivation fees may apply.
3.3 Public Information: The client accepts that domain registration information is public (Whois) according to ICANN regulations and territorial registry policies.
4. Digital Products (Bots, APIs & Extensions)
4.1 Third-Party Dependency: Our Bots (WhatsApp, Telegram, etc.) and APIs depend on external platforms (Meta, Telegram, etc.). WavingCode is not responsible for changes in policies, API updates, or bans imposed by these third parties that may affect product functionality.
4.2 Licensing: Services are provided under a license of use. Redistribution, resale, or reverse engineering of the source code is strictly prohibited.
5. Acceptable Use Policy (Zero Tolerance)
The following activities are strictly prohibited:
- Spam: Sending unsolicited bulk emails. We maintain a Zero Tolerance Policy regarding Spam. Violation will lead to immediate suspension without refund.
- Illegal Content: Hosting malicious software, pornography, gambling, pirated software, or material infringing on copyrights.
- Resource Abuse: Excessive use of CPU, RAM, or Inodes that impacts other users on the server. WavingCode reserves the right to suspend accounts causing disproportionate load.
6. Billing & Payments
6.1 Upfront Payment: All services must be paid in advance. No refunds are issued for overpayments; these will be kept as credits for future services.
6.2 Payment Default: Overdue accounts will be automatically suspended. Services deemed "abandoned" may be permanently deleted without prior notice.
6.3 Taxes: If a legal invoice is required, the client must provide complete tax information within 30 days; otherwise, the invoice will be issued as "Final Consumer".
7. Refund & Money-Back Guarantee
7.1 Period: We offer a 100% money-back guarantee during the first 30 calendar days.
7.2 Conditions: Refunds apply only to technical issues directly attributable to WavingCode's infrastructure that prevent the normal use of the service.
7.3 Exclusions: The following are NOT refundable:
- Domain registrations, renewals, or transfers.
- Advanced technical support or consultancy services.
- Digital Products (Bots, APIs, Extensions) once credentials or downloads are delivered.
- Accounts suspended for violating the Terms of Service or Spamming.
8. Technical Support & "Best Effort"
8.1 Scope: Support is limited to the infrastructure and platforms provided. It does not include web design, client-side programming, SEO optimization, or third-party software configuration.
8.2 Best Effort: Any additional assistance exceeding the included support is considered a "Best Effort Courtesy" and does not constitute a contractual obligation or a guaranteed result.
8.3 Conduct: We reserve the right to suspend support for any client using offensive language or threats toward our staff.
9. Client Area & Security
9.1 Official Channel: The Client Area at clients.wavingcode.com is the only official means for requests, support, and billing.
9.2 Credentials: The client is solely responsible for password security. WavingCode is not liable for actions performed using valid credentials obtained through client negligence.
9.3 Contact Email: The client must register an email address external to the contracted domain to ensure access to the account in case of service failure.
10. Data Responsibility & Backups
WavingCode does not guarantee complete data restoration and is not liable for any loss of information.
11. Governing Law & Disputes
These terms are governed by the laws of Ecuador. Any legal dispute shall be resolved in the courts of Ecuador.
